USCIS Issues Guidance on Employment Eligibility Verification Form

WASHINGTON—U.S. Citizenship and Immigration Services (USCIS) announced today that the Employment Eligibility Verification form I-9 (Rev. 02/02/09) currently on the USCIS Web site will continue to be valid for use beyond June 30, 2009.

USCIS has requested that the Office of Management and Budget (OMB) approve the continued use of the current version of Form I-9. While this request is pending, the Form I-9 (Rev. 02/02/09) will not expire.

USCIS will update Form I-9 when the extension is approved.  Employers will be able to use either the Form I-9 with the new revision date or the Form I-9 with the 02/02/09 revision date at the bottom of the form.

Departments are responsible for the completion of a Form I-9 for each employee they hire. Federal law requires the completion of the Form I-9 in order for both US citizens and non-citizens to work at Indiana University.

Employees must complete Section 1 of this form and the hiring department is to complete Section 2. Federal law requires that the employee be stopped from working if either section of the Form I-9 is not completed within the specified time limits.

The most recent version of Form I-9 can always be found in the Forms section of the UHRS Web site.

Section 3 – Updating and Re-verification

Departments must stop individuals from working who fail to complete Section 1, do not produce the necessary documents in Section 2, or do not re-verify employment authorization when a work authorization document has expired.

Departments are to submit the completed original Form I-9 to the campus Human Resources or Payroll office, as designated for the campus and retain a copy of the completed Form I-9.  Copies of the documents submitted for Sections 2 or 3 are not to be retained.
